The County Short Term Disability Plan In the case of a disability, people often think of permanent and total disability or long-term disability.
Usually, the time taken off three levels, namely:
aec sick leave for the person who needs a few days off
aec Short Term Disability (STD) for short periods of disability for one or more weeks
aec Long Term Disability (LTD) for long periods of disability
The County of Los Angeles offers STD plan that provides income replacement to the ill, injured or pregnant employees in the county. Where a dispute arises under the plan, Short Term Disability lawyers must be consulted.
The latest census of the United States, approximately 12% of the working age population of Los Angeles had some type of disability. About 42% of disabled employees are reporting, compared to 74% of those without disabilities.
Short Term Disability defined
Handicapped, under STDs, means that the state prevents a person from performing their regular duties and customary or modification of their duties as an employee of the county. This definition takes into account the following factors:
1. The severity of the medical situation
2. The type of work
3. The duration of disability
4. The type of work able to perform
Short-term benefits of people with disabilities
Employers pay a portion of the salary of their employees between the time the sick leave is exhausted and begin long-term disability.
The benefit is typically between 50% and 75% of salary. Some large employers pay 100% of salary depending on length of service before reducing the benefit to a lesser percentage.
Payment is usually a percentage of gross weekly earnings excluding bonuses, commissions or overtime will be specified in the plan document.
How can I receive benefits STD
To enjoy the benefits under the STD Plan, you must be registered to it. Upon registration, prospective employees must choose between the two benefits, namely:
aec Basic Allowance which is a period of 14 days of waiting followed by 70% replacement income, or
aec Additional benefit is that a period of 7 days of waiting, followed by 100% income replacement for 21 days, then 80% income replacement for the remainder of the approved STD.
If you select the added benefit of STDs 100% - 80% income replacement for STDs is not payable under the laws of workers' compensation in California.
In case of accident or illness, a maximum of 70% income replacement due to STDs is an individual. The waiting period MTS remain equal to the sum of days waiting period you have chosen is in the kernel or an additional benefit.
Waiting period defined
Most plans in the short term disability not start paying until the employee has been absent for a week or until the sick leave has expired - whichever comes first.
The waiting period begins the "first day of disability, as certified by your health professional, and ends the day you have the right to receive payments of STDs."
A day "for the waiting period, is considered a calendar day." This includes weekends, holidays, and any other regular day off.
You are not entitled to payments STDs during the waiting period.
Duration of benefits
If approved by the Administrator of the third (TPA), STD benefits may be exercised during a maximum of 182 calendar days from the first day of incapacity for work without compensation.
The duration of a disability depends on the situation as determined by the TAC, based on medical information received from your health professional.
Payments of STDs in the county of Los Angeles
STI payments are paid by the County of Los Angeles, not the TAC.
