San Diego Property Liability

Posted on March 28, 2010.
San Diego Property LiabilityWho is responsible for the failure of the property tax?

I just bought a new house. Three weeks after the closing, I received a notice from the County of San Diego that the previous owner had failed to land tax. Now the county billing, it's me. Is it my responsibility because I'm the new owner? sounds unfair does not it?

The property is responsible. You will have to pay if you want to keep the property. I suppose the escrow instructions called for property tax will be distributed at the close of escrow so if there were arrears of taxes, they should have been paid and your escrow operator must pay you. You can also have a cross in the mail problem.

Who was your fence, and the seller does give you the title insurance to protect yourself? In general, you should have received a credit from the former owner of any property tax for tax years by the closing date. The company that processed the title of the fence should have taken care of all taxes due before or shortly after closing and if your lender escows taxes, they must take care of property tax payments after your receiver.

In my case, my property taxes (IL) are not due until the following year. So when I closed on my house in May 2002, I received credit for all of 2001 taxes due in 2002 and part of 2002 tax due in 2003. Unfortunately, the title company paid the 1st installment very late and two were not paid, the lender and neglected the plight double, so I had to pay out of my pocket until I have to pay back, but it ' was a different story.

Congratulations, you just pay more for your house that you wanted. (The amount you pay will be added to your base. It is not deductible.)

You can still continue the previous owner.

Yes, it is your responsibility, but you must be insured. The responsibility moves with the property. Talk to your insurance company title.

I would like to contact the estate agent and lawyer regulation. This should have been supported (by the seller) at closing.
