What is the limit for medical malpractice award in California? If my family has decided to pursue this claim, I have no idea what the limit or ceiling is or if it exists. We live in California, and I do not know where to look for the right to show my family.
There is no ceiling on recovery for economic loss (eg, medical expenses, job loss, etc..) There is a $ 250,000 cap on non-economic losses (eg, pain and suffering). (Civil Code Section 3333.2.)
The interesting thing is that juries are not talked about this cap and can not reach a verdict as they believe the applicant should be granted for non-economic damages. Following the CAP, some juries have been reduced by millions of dollars. Whether you think it's a good thing or not probably depends if you think that juries are monumentally stupid or not (and if you think they are, why you support a jury system at all).
