I practiced law for 30 years. I've never had a customer ask me if I had liability insurance.

I would not have been offended if they asked.

It's funny how people think lawyers are opposed to the question. I always told customers to ensure that their tenants, subcontractors, contractors and others, they were treated liability insurance. Should I also do?

Ask the lawyer to say that you are sophisticated enough to want to be sure you are fully protected. Malpractice happens to the best of lawyers can come from events beyond the control of the lawyer as his hospitalization and missing a court deadline or a mistake committed by a subordinate.

Do not be confrontational, just ask and explain that you've heard that some lawyers and doctors are not insured and is a risk you do not want to take. Tell the prosecutor that you have heard good things about it, but this is just business, not an attack on his skills. Add that if you thought they were not capable, you would not hire them first. A malpractice suit is never as good as the adequate representation and they never make anyone (you have to give another lawyer 1 / 3 or more than once just to get them to take the case).
