Credit Life Insurance PolicyGMAC then be liable to let someone to commit fraud on a policy of life insurance credit?

Dad bought Tahoe GMAC, they (dealer, who is known for 30 years) knowingly news that he had all the conditions listed in the request, but leave to apply anyway. My father died 8/09/06, now sends credit life forms want to know all the health problems. If had no problems, then car would be paid, otherwise my mother will get the $ 2,220 price of the policy. In a certain way should not have GMAC fraud charges on them or some sort of consequence. In addition to the concessionaire, the financial person knew he had all the diseases. How can we allow someone to apply, whether they have any diseases they will be denied and if not respond to disease and life is credit to the applicant's medical history, which then the applicant can get accused of fraud.

Honey, the guy who committed the fraud appears to have been your father. I'm sure they have his signature on the document explaining the conditions of the policy.

The problem is that you can not not let someone apply is unfair discrimination. The type of sale at the dealership is not a physician is not allowed to diagnose conditions, is not allowed to make judgments about the health of your father.

The dealer will probably get slapped, but that will not help your situation at all. Your father would have been required to sign the documents, verify the veracity of the claim. If he did not sign it, then this is not a valid contract anyway.

I'm sorry to hear about your situation. Have you a father, which all other life insurance your family can use? (Insurance Company, work, bank, etc.?)

Ok GMAC dod not fraud, the person in the merchant ship did fruad and father (sorry) has signed the request, saying he did not have these things. Thus, the dealer and your father does fraud. GMAC does not underwrite these policies. Now they have a claim, they received some medical information showing that he had things he said he did not have on the application.

So if he lied (merchant ship lying) on the application you Merley get the money you paid (and honestly not sure they would have to do because the insurance claim was a fraud.


The dealer has tried to help Dad, I guess do not think he would die, of course, and they get their commission for the sale of policey.

but in the end it is the person who is signing the applicatin to be sure it is always telling the truth.

I see what you say, sort of. But, applying for credit life is an individual decision. Your father has had to fill out the form and sign it, and not the dealer or the CFO. You say that the dealer filled the request of your father and he had not disclosed terms? Were you there to see what happened? You should talk to the dealer first and see what happened. Maybe he can buy the truck at a good deal (for your mother).

Maybe a good question for a lawyer. Are there any witnesses who saw how the application was completed and how the questions were asked. Insurance agents can not be held liable if they submit an application with knowingly false answers to health issues. Legal questions should be answered only by lawyers and can get a good could your mother Tahoe by threating a lawsuit. Just for thought.
