Annuity ExchangePosted on January 11, 2010.  Annuity Exchange 1035 Question? I watched a free annuity contract in exchange for another policy but the insurance company sent the check directly to me and not the other insurance company that I ride to silver in 2008. I put the check for $ 150,000 in the bank and wrote a personal check in the days to the new insurance company. Is this renewal of a taxable event or should it still be considered a 1035 exchange because it has been transferred in the days? Provided that the pension application reflects the new exchange 1035, you have 60 days to deposit the check. As long as you have 1035 exchange documents completed by the company to accept the exchange, you should have no problem. In addition, you should ensure that the dollar amounts are identical and that the owner / annuitant / etc are identical (names, SS # s, address) as a 1035 exchange requires a "like-for-like "transfer. If I understand correctly (and I may be wrong) is that by putting the check to the bank to cash in and essentially - it would not be eligible for an award of 1035.
