Accident Policy

Posted on February 19, 2010.
Accident PolicyWhat insurance will do if the two sides of the car accident all the politicians with the same insurer?

I had a car accident and I think it was the fault of others. However, the third and I have the same policy of insurance company. Legal insurance is the same as well. What should I do to ensure that insurance should act without conflict of interest? If I use the various law firms, will it be better?

You have an advantage in that the insurance company will be two versions of the people of the incident and be able to better allocate responsibility quickly. They must inform you of the conflict of interest under the rules of the FSA. The fact that you are insured with the same insurer does not affect your rights under the contract (they must repair your car if you have full coverage) does not affect the rights of the other driver under contract (the insurance company must pay damages you claim against him - under the section on liability, if they think he is at fault).

Hopefully the insurance company will soon decide who is at fault and you pay your uninsured losses (excess, loss of income, etc. injury). If not, you have to consider the insurance and legal fees to see if there is an exclusion against them pursuing a claim against the insurer. If so you probably have to complain that they do not treat you fairly because of conflict of interest.

It will certainly be cheaper and easier if the company paid legal pursues a claim on your behalf - the only problem you have is whether the other driver denies liability - and its political support for legal protection to claim against you. In this case, they will have to withdraw because of a conflict of interest.

The insurance company can offer a split responsibility. You may challenge this if you want to preserve your claims bonus - but it will delay the payment of uninsured losses until the claim is settled. In this case, I suppose the other driver would be the continuation of an application and at a time and you'll need to take legal advice elsewhere.

http://carquotes.50webs.org - try this one. I have their auto insurance and, as I know, they can provide such a service. Flag

Your insurance company will not try to blame you for no reason, they do not care about the 3rd party is insured for, it''s simple, if you caused the accident, you lose your claim and any excess of your policy, If you do not bring your no claim will be safe and you will get your excess back ..

Contrary to public belief, to adapt and insurance try to be fair and they are subject to when deciding who is at fault when it comes to accidents ..

the insurance company will pay policy that is at fault. it would not matter if you had identical or different companies.

I have the same problem since last 4 months, they are supposed to be independent on both atcing Behalf ..

It should not need a frm legal claims if injuries persoal

they must by law be fair

I feel for you. The same thing happened to me. Although the state mandate that the various divisions of the same company manage demand to avoid any conflict of interest, we were both equally screwed by the company. Be sure to use a different law firm, and check what their record is against this company. Some lawyers are not as good as their flashy ads you believe.

He ended up not being a good neighbor thing at all for me.

There can be a conflict of interest if you think about it, the company will eventually pay.
